The problem is that an old moped is considered a salvage.

It's really not worth it for ether sides, but what you should do is make sure your ass is covered so the insurance company doesn't go after you.

You could probably fight it in court and say the pay out was not enough to replace your bike but is that worth it?

If u really wanted the cash then u should of had the guy pay you off so his insurance didn't go up

Right! Not ripping on the OP but getting an appraisal after the crash and after contacting the insurance company is probably going to do very little.

I'd go after the other persons insurance on money for replacement.

If it's a No Fault state then that may only get $500 or so sadly.

Show them craigslist printouts. theres always crackheads thinking they can get 2500 dollars for stock mopeds.

Show them itemized lists of prices like

handlebar 25.00

fender 50.00

labor 100.00 an hour for probably 6 hours work.

etc........

even if its that old its highly unlikely the appraisal value would be $0

Tell them you want it repaired perfectly so you can rent it out to people for movie filming purposes.

I appreciate you guys and gals not being too hard on me. I’m happy I’m here to be able to read these responses.

I was more or less just curious because I feel like I had a car that was worth less and in worse condition than my moped and it still carried some value when someone hit me.

Either way, never been in this situation before and hope it never happens again, especially to anyone else out there on two wheels motor or not.

blake at DOS might be able to help with value. also, new tomoses are "similar." i've been hit a few times and it sucks. however, if you got hurt, and you got a lawyer, you should be in for a decent settlement. were there any witnesses? car at fault? don't feel bad about suing people. that's what insurance is for. hopefully they will let you keep your totaled bike. sometimes that gets complicated.

ALWAYS GET at least Double stacked or triple stacked uninsured / underinsured. if GOd forbid you get hit and run. you can sue your own insurance co to cover your medical and get pain and suffering included in the settlement. no cash for moped parts tho...

with all the man hrs and parts / lack of parts considered. it is totaled as far as the ins is concerned standard buy back is 20% of the agreed value as far as salvage goes.

750.00 in the 1970's is equal to about 2000.00 today. a new tomos moped is about 2000. they were 650.00 in 1977.

Dude The court system is so fucked up, you can get away with anything if you are rich enough. There should be no pay outs unless it's to cover injuries and or the cost of the bike. Il never understand people suing because there is way to much money involved and we are also putting a price on something that's priceless.

The point about insurance you are missing is that you wouldn't have to "lawyer-up." Your insurance company would take care of all the legal bs.

Yes! In the process now. Found a member on here in my area who has been great for parts and super helpful!
