I'm pretty sure your settlement would be reduced by statutory limitations in the event that you didn't utilize a lawyer...

If you get a bum settlement, it likely has more to do with your insurance and the tortfeasers insurance than the attorney that you hire's fee for licensed professional services.

Alex, I know this is too late to help you with your current hell, but this is exactly why you want to carry a lot of Under/Uninsured coverage. For instance Geico will sell you a policy with up to $300K of U/U. Get it. Sounds like a lot, but medical bills can eat that up in one gulp. I think Progressive will do $500K, but I don't remember for sure.

It usually doesn't cost very much to bring the policy up to those numbers. If you have high U/U coverage then the offender's insurance company will be WAY MORE LIKELY to pay up, because they know that your insurance company will go after them for it.

This is also why even if you ride a moped, and/or are not required to carry any insurance in your State that you should go out and get insured. The FUCKING HONDA CIVIC drivers don't give a fuck what you are riding. They will run you down with equal proclivity.

As far as LAWYERS are concerned: There are some good ones out there, but there are a hell of a lot of assholes too. Like the one that opened this thread. When you sign with them make sure you get some help on the agreement so that they don't get 1/3 of the settlement for sitting on their FUCKING ASSES.

Look up terms like poison pill, and set date goals in the agreement too. For instance if they don't close the claim within a year they start losing percentage of the settlement for each allotment of time in which they don't close the claim. This will keep them from dragging it out for five years. Also, that they relinquish all claims to any of the settlement if they don't perform within x amount of time. Without these types of clauses in your agreement the lawyers are likely to send you into a state of silent flatulence.

If you don't think attorneys fees are worth it, you can always try representing yourself.

If you don't think your surgeon's fees are worth it, you can always do the surgery yourself.

What's that? Your insurance pays the surgeon?

Guess who pays the attorneys fees in your personal injury case: the insurance company. Common fund lien reductions can easily pay for themselves.

It's not really a third of your money, it's a third of the insurance companies' money that was paid to you so that you can repay your insurer. Short of gross or criminal negligence, damages aren't punitive.

Sometimes I get the vibe that people think personal injury claims are winning lotto tickets :(

Is it legal? I work for lawyers. And I've seen better call Saul so I'm basically a lawyer too now and I thought soliciting was a big no no.

You must not watch much TV . If a commercial isn't for a new drug , it's likely for a lawyer hawking their wares .

I do watch tv. Which is why I mentioned better call Saul in which he gets in a fuck ton of trouble for doing just that.

It's a very very thin line you walk in doing that. At my work they watch us like hawks. Someone was given a gift of a knife and some chocolates a month ago by someone who was going to be sued by us. They were not allowed to have them.

Any appearance of impropriety is verboten.
