i took a guys ped in for repair. he didnt contact me (or so i thought) for some months. lost his info. put up an ad on craigslist asking if i had your maxi, no replies. sold it to a kid, who then put it on craigs. guy sees it, tracks me down and has filed a police report on me. i have to pay him 350$ by friday or hes pressin charges. sucksville, cus im broke. unemployed too. he went and told bj what a dick i am. i feel shitty. i gota pay dude back. its the only right thing.

he isnt counting the work i did on the bike tho......... oh well. my own stupid fault. stupid.

Nah. I think he's the dick. Worth taking it to court? If you got a small business... that's all time money and resources you had to put out in order to service a ped he abandoned. You tried to reach him and made a public notice addressing him

What can the police do? I mean he did leave it at your place. If its being handled as stolen property... shouldn't it be recovered from whoever it was sold to? Was it registered in his name? (edited)

Well since you're storage rate was about 1000 dollars a month...I'd say you could file a claim against him. Unless he has proof that he left the bike with you and that you sold it directly to the seller on craigslist..I think he'll find it hard to press any charges. If he has proof that he left the bike with you for that time period...then I'd say you can press charges since theres proof that he left the bike in your hands for that time period without contact or payment for storage of the bike.

Pretty much I dont think the guy can prove anything and if he can...then you can prove that he's stored the bike at your place for several months and owes you as much as you'd like to charge him for storage fees.

Dude, go talk to a paralegal or lawyer in your area and ask them. I'm pretty sure you'll be all good. Fuck that guy, It's not like you didn't try or anything. You said you had it for MONTHS and he never contacted you. Did he have your phone number?

nah, a dick wouldn't give a shit. Let him press charges so that it goes to court. He might not be that motivated and is just trying to intimidate you. Organize any paperwork, notes, scribbles, parts ordered, ANYTHING so that it shows you were acting as a responsible punctual mechanic. The CL ads are probably taken down, so those don't do any good, unless you printed them out while they were up. The work you did won't really do any good since the original owner didn't get to witness or enjoy that. But, the worst that can happen is exactly what you're willing to do right now, which is pay him. It's HIS responsibility to prove that he emailed anything to you. If he doesn't have that, the court may side with you and you don't pay him anything unless you want to, or give him some other moped just to ease your conscience. Good luck with it, and just remember that the courts are full of people much worse than you....

also, print out the thread you posted on here about it. We all remember that, and the judge would know that a real moped rider checks this site frequently. (kidding) but it did attract a lot of attention in the moped world.

Our shop had a sign up for all repairs saying 10 days to pick it up from the time we left a message that it was done before we sell it. Mainly to scare customers into picking up their junk, but they did end up getting sold 6 months to a year later or parted out.

check the mechanic lean laws in your state. i'm not sure if you need a business license or not for them to apply though. usually if a bike is left over thirty days from the job finished, and the job has not been paid for, the bike becomes the property of the mechanic. i've had to apply this too one bike this year at the shop i work for.

he abandoned a bike at your place, you waited a year and tried to get in touch but couldn't, so you sold it. i think most anyone would agree that the bike was your property at that point.

in Michigan you have to be a licensed mechanic or a shop owner to apply a mechanics lean. if you would have registered it in your name through a barn find/abandon vehicle type of thing you would be good to go. the most they can get you on is jumping title if your in a title a ped state.

I would try and compromise. You have a legal leg to stand on. Like a roommate moving out, leaving shit there, and coming back a year later expecting you to pay for anything he left there. you showed due diligence. However you are not a Dick and have a moral conscience. Hence your willingness to pay him.

I would offer to split the difference, with storage charges being half. Pay the other half? Just my 2 cents.

If bj had someone leave a bike at handybikes for a year, I wonder how he would handle it?

you might have to be a licensed mechanic to get a mechanic's lien but you can lien a vehicle when ever it's left on your property. I do this for when I buy a vehicle that has gone through a bunch of hands and doesn't have any paper work left. I just say it's been sitting at my house for a couple years.

If the dude dropped it at your place and knew where you were and didn't come to get it it's his fault.
