It might be wise to call the local DMV and get the requirements for "moped" classification before you buy anything or you're gonna need a valid driver's license. A scooter aint gonna cut it.. and neither is anything that goes over 30 MPH.

In North Carolina you must be at least 16 years old and wear a helmet to operate a moped on a public roadway or public vehicular area. i think Brian is on the right track here, pedals put the "ped" in Moped, if you want a min. topspeed of 45, get a scooter.
