<HTML>In Ohio, I found you should not use a moped to go on a beer run after you've had a couple. Or at least make sure the 12 pack you have strapped on the carrier rack is in a plain brown paper bag. They have a new law here which allows them to bust you for DUI (not DWI) if you have access to any kind of motor vehicle (don't even have to be in or on it) and they can smell alcohol on you (even if you haven't been drinking it). Haven't seen what they'll do to me on an electric bike or lawn mower yet, have to get this last fine paid off.</HTML>

What I've learned: I'm in Indiana, which is one of the few states that does not require a driver's license for certain scooters... they don't even require license plates, registration, etc. There are definite laws that apply re: what these scooters are... what they differentiate between being a "motorized bicycle" and a "motorcycle" ('their terminology).

Indiana has a great website (somewhere) that has their entire legal code. Do a few searches and you can read all about this if interested.

One thing I can tell you is, it has to be under 50cc... the Honda Elite (and I think a couple Yamaha's) "happen to be" 49cc, so its a fairly liberal law. Not unusual, though... Indiana is one of only a few states that has no helmet law, either.

So... 'move to Indiana and buy a scooter.

"Thoeretical" question here... I'm sure this varies state to state, but as a general rule... if driving a Moped doesnt require a drivers license (or does it?) ... could you get arrested for drunk driving? please email with replies... thanks!

My friend here in Belgium was caught drink driving a Bike, yes peddle bike, he was fined and spent the night in jail to sleep it off. His parents were not impressed!

in the state of missouri, USA if you are

drunk and the car is parked and off but

the keys are still in the ignition then you

are considered in control of a motor

vehicle and would be arrested as a dui

is that dumb or what

so , if drunk and riding a moped i would

have to think you would also be arrested

for whatever reason. i guess you

have to be a lawyer to figure this out

I always get caught reading these old posts, but yeah, you can get a DWI on a moped in MN, and why not? It is a motor vehicle?

I would guess that, license or not they can get you for drunk in public and open container? here in NY if you take aspirin before driving you risk dui.

A few years ago I went to visit a buddy who was taking classes to become a police officer. While I was up there I went to a class with him. The class was about what a DUI is. I don't have all the legal lingo stuff down but basically, if you are in control of any vehicle (anything besides your two legs. This can be a bike, or a horse, or a car, or whatever) you can be arrested for DUI. in the end though, if you drink and drive, you are a damn fool, and deserve any legal shit you may get into for doing so.

These days ya can get a dui if the boots ya in are vibram.

Be smart. Dont get tossed while out on the ped but also for town bar hoppin mopeds are gods gift to us peoples. Maybe Dont be on a loud ripper machine and dont be bone head evil knievel either.

In NE , you cannot get a DUI or a bicycle, golf cart, or electric bike.

Some people recently have been in the news for being charged with DUI on a moped but Nebraska Appeals judges and some District Court judges have dismissed charges brought against riders of pedals mopeds. So pedal equipped mopeds and motorized bicycles, no.

You can get a DUI for riding a noped or scooter drunk. (edited)

In Illinois, you can be charged with DUI while riding a bicycle, if it's on a roadway. A bicycle is a vehicle in IL when operated upon a public highway (their description for roadway). Peds are licensed vehicles in IL anyway, titled and plated.

Driving While Intoxicated.... Depends on how state defines intoxication . Some states include under the influence of drugs or substances like glue, pot, meth etc.
