You gotta be careful when they ask you the questions on the form.
1) Engine may not exceed 50cc
2) engine may not exceed 1.5 brake horsepower
3) operable pedals required
4) auto transmission
5) design speed may not be more the 25 miles per hour
6.) not require inspection
When they ask, even if it's not true, answer it correctly. engine? 49cc brake horsepower 1? you get the idea. this is especially true for the 25 mph thing, just say i'm lucky it does 20. if you answer one of them incorrectly you could end up with a motor driven cycle, which is technically 50cc but could land you in a class M, or a class M 8 restricted.
it's easier just to take a VIN tracing in when transfering titles from out of state and registering, etc. that way they don't actually look at the speedo. of course, if it's an existing titled bike, you're probably subject to whatever they registered it as previously.
