you can’t use state laws to define what something is. just because some old fat dude put a label on something he had no idea about doesn’t mean it’s true.
i would still consider tomos with pegs a moped because they are available with pedals. pedals are standard, pegs are an option. if you could have bought an express from honda with pedals, i would consider the express a moped, but pedals were never an option, and therefor an express is a noped.
the moped/scooter thing isn’t black and white. it’s not one or the other, there are many bikes that are neither.
